This post contends that the bank used in money laundering could be held liable for the amount allowed to be withdrawn after the stop payment request was received by the bank.   RCBC legal counsel and chief enforcement officer contends that Philippine law does not allow banks to  such freeze or hold order, even if the money was stolen.  Even more so for dollar accounts without the consent of the depositor..

“Section 8. Secrecy of foreign currency deposits. – All foreign currency deposits authorized under this Act, as amended by PD No. 1035, as well as foreign currency deposits authorized under PD No. 1034, are hereby declared as and considered of an absolutely confidential nature and, except upon the written permission of the depositor, in no instance shall foreign currency deposits be examined, inquired or looked into by any person, government official, bureau or office whether judicial or administrative or legislative, or any other entity whether public or private; Provided, however, that said foreign currency deposits shall be exempt from attachment, garnishment, or any other order or process of any court, legislative body, government agency or any administrative body whatsoever.”

Even the Senate inquiry into the 5 accounts, as dollar account, as foreign currency deposit may be considered in violation of the said law.   This law needs to be amended too?  It can not be frozen nor forfeited?

  But Sen. Osmena said he asked other banks, and said they would unilaterally stop the payments if they knew it was stolen.  (But I know that a certain financial institution did not allow, for our claim for  stolen amount deposited with them)

It is not the obligation of the bank to determine the source of funds, even if the source of the said funds was CB of Bangladesh.  In so far as the local bank is concerned, the owner of the funds are the 5 account holders, even if they were fictitious (thus Sen JPE was right)  Only AMLC has the authority to freeze, not the bank or its  enforcement officer:

SEC. 10. Authority to Freeze. – Upon determination that probable cause exists that any deposit or similar account is in any way related to an unlawful activity, the AMLC may issue a freeze order, which shall be effective immediately, on the account for a period not exceeding fifteen (15) days. Notice to the depositor that his account has been frozen shall be issued simultaneously with the issuance of the freeze order. The depositor shall have seventy-two (72) hours upon receipt of the notice to explain why the freeze order should be lifted. The AMLC has seventy-two (72) hours to dispose of the depositor’s explanation. If it fails to act within seventy-two (72) hours from receipt of the depositor’s explanation, the freeze order shall automatically be dissolved. The fifteen (15)-day freeze order of the AMLC may be extended upon order of the court, provided that the fifteen (15)-day period shall be tolled pending the court’s decision to extend the period.
No court shall issue a temporary restraining order or writ of injunction against any freeze order issued by the AMLC except the Court of Appeals or the Supreme Court.

Thus these loopholes must be plugged by the Senate according to the RCBC legal chief. Estavillo. The perpetrators of the theft really studied the laws, observed the loopholes and leveraged this to their advantage.

Anti Money Laundering Act of 2001 (RA 9160)

Estavillo is right; there is no provision for freezing of an account.    only forfeiture proceedings may be enforced upon order a competent court.  or freeze order from AMLC  As with regards to inquiry on deposits and bank secrecy, only orders of competent court shall allow AMLC or any other body to inquire into a bank account (it does not state whether the said provision may be waived in case the count is determined as fictitious.)

Authority to Inquire into Bank Deposits. – Notwithstanding the provisions of Republic Act No. 1405, as amended; Republic Act No. 6426, as amended; Republic Act No. 8791, and other laws, the AMLC may inquire into or examine any particular deposit or investment with any banking institution or non-bank financial institution upon order of any competent court in cases of violation of this Act when it has been established that there is probable cause that the deposits or investments involved are in any way related to a money laundering offense: Provided, That this provision shall not apply to deposits and investments made prior to the effectivity of this Act.

But a crime has been committed.  RCBC should have at least delayed or confirmed the transaction before allowing withdrawals.

Are fictitious accounts covered by bank secrecy law?

According to Sen Enrile it is merely the opinion of the gentlemen at the Senate hearing that the 5 accounts at RCBC Jupiter  are fictitious and therefore no longer subject to RA 1405 (bank secrecy law)  He believes that if we are to comply with the law, we have to have a competent court determine that, not Senate, because evidence obtained under duress, or in violation of the law will be inadmissible for future court proceedings.

There are only four (4) instances under the law where bank deposits or investment in government bonds may be disclosed or looked into, namely: (1) upon written permission of the depositor; or (2) in cases of impeachment; or (3) upon order of a competent court in cases of bribery or dereliction of duty; or (4) in cases where the money deposited or invested is the subject matter of the litigation.

Sens Guingona, and Pimentel a bar top notcher think fictitious accounts are not covered.  AMLC head Abad think they are  be exempted. but Circular 706 (guidelines for AML) of CB does not amend the secrecy law and merely states "deemed" and is merely a CB Circular.

This means that, notwithstanding Circular 251, deposit accounts cannot be examined or looked into except under the limited circumstances provided for in RA 1405.

 Why are the BSP and the BAP advocating the amendment to bank secrecy laws?

 The proposal of BSP and BAP is for access to deposit accounts only under exceptional circumstances, such as deposits only above the P50-million level and in relation to the commission of serious offenses like racketeering and illicit drug trade. Except for these instances, depositors and those with legitimate transactions remain protected under RA 1405. The objective of the proposal is to institute this measure as an anti-money laundering campaign so as to delete the Philippines as a non-cooperative country in the list of the Financial Action Task Force against money laundering.

There is a continuing secrecy under this FAQ, the prohibition on fictitious account notwithstanding.   Now the case at bar vs Deguito may be the basis for the examination of account under condition #4.

Freezing/stop payment of transfers

The law does not allow the stop payment of transfers,   especially for dollar accounts, even for fictitious accounts according to Estavillo, head of RCBC legal department.  She hopes Senate can plug the loopholes in the law

The RCBC money laundering case, if we are to believe the story tellers, are lessons in timing (promptness) and obedience and compliance to procedure.  It also shows lapses in vigilance and attention to details.  It can happen to anyone.  But RCBC, having ignored the stop payment order for the remaining amounts, still not withdrawn could be held liable for the amounts withdrawn after the stop payment order

The half day hearing of the Senate on RCBC money laundering gave us lot of education on laws, management and internal controls, casino,  the minds of criminals, scam, how to iwas pusoy (put blame on others) and insight on how the senior officer of the country think.

1.  Sen. Serg Osmena's questioning of RCBC prexy.

    The RCBC prexy said it is a correct balance of speed of transaction/ and control that must be managed in a bank to serve the millions of transaction that take place every second.  The good senator that despite the size of the transaction, the RCBC prexy seemed not to have known that something was happening that he should taken action on.  Mr. Tan, passed on the responsibility to sub alterns and the system which failed.

Comment:

  Iwas pusoy ang sagot.  He can not escape that responsibility.   Perhaps the IT computer system, or the reporting system in their bank has gaps to comply with the AMLA law.   I would like to think that the failure on the part of the bank to implement the stop order or comply with request of CB of Bangladesh to verify the beneficiary of the transfers make RCBC liable civilly for the $81 million dollars return to Bangladesh.

Everytime there is a bombing or acts of terrorism by extremist, all we could is to condemn the killings and pray for the victims and the dead, and probably the perpetrators.  At the end of the day, we do no nothing. Perhaps, the perpetrators will be caught. That is police work, or probably that of the military and we hope the extremists will stop.  Several months later the cycle repeats and the extremists are it again with suicide bombings..  A woman at Brussels was interviewed and she said why is the city being attacked;  why are they being included; they have nothing to do with those who carried out the bombing.

1.  We can not naively believe that because their religion instructs them to do so.   Non believers, the infidels are all subject to jihad.  The Islam Q uran states

9:123 "O you who believe, fight those of the unbelievers near you and let them see how harsh you can be. Know that Allah is with the righteous." 

2.  The ISIS has declared war vs the Vatican, and of course the Christians:

Counter jihad is proposing such a solution:  banning mosques, banning Sharia law.  Japan even bans importation of Quran in Arabic.  We need to be patriotic. In the Phil, I think it is ok for Muslims to have their own country in Mindanao, secede and forever remove Muslims in Luzon and Mindanao.  And implement what Japan has decreed for Muslims. That is the only way we can avoid trouble with Islam Exremists.  They should have visa when they visit Visayas and Luzon.

Ever wondered why there are no jihad attacks in Japan.  Muslims are not allowed in Japan.  Out of  100 million plus Japanese, there are no only 10,000 Muslims in Japan. It is a simple equation. Japanese leaders seldom visit Muslim countries.   Japanese women are ostracized when they marry Muslims.  Quran is not allowed in Japan.  There are no  mosques.

It is that simple.  No Muslims, no jihad.

So Muslims should not hate Trump for proposing to limit the entry of Muslims who could be jihadist (jihad is essential part of the Islam religion, it is not an extreme ideology) after a terrorist attack in California.  It is the duty of the leaders of a country to provide safety and security for its citizens, even it means screening/keeping out Muslims.  USA can not continue to import adverse elements into its territory, like pests, or food or drugs.  USA does not have to buy oil from Muslim countries.  Muslim countries will get impoverished if they do not sell oil.

Jihad is an integral part of Islam  There is no religious intolerance in Islam.  Its aim is to conquer the world

The word jihad occurs in the Koran in 164 separate verses.  Jihad as war is set apart from the tribal warfare common to Mohammed’s lifetime, and sanctified as a special and divinely-blessed activity.  It is both a duty and an opportunity to gain in divine favor, and to enrich one’s self through the seizing of the goods of non-Muslims who do not yet submit to Islam.
Islam’s greatest philosophers endorsed this position.  Avicenna, the Persian philosopher frequently cited by Muslims, Jews, and Christians alike, wrote of jihad in this way.  Jihad was in a class of beneficial acts, he said, that were good not only for the soul but for “worldly benefits,” because you got to plunder the enemy.  (This is in his Metaphysics of the Healing, Book Ten, Chapter Three, if you are following along at home.)  He went on to write that, “as for enemies and those who oppose the law, [the legislator] must decree waging war against them and destroying them — after calling on them to accept the truth — and [decree] that their property and women must be declared free for the spoil.” (That’s in Book Ten, Chapter Five.)
Likewise, in Reliance of the Traveler:  The Classic Manual of Islamic Sacred Law, Ahamd ibn Naqib al-Misri states that “Jihad means to wage war against non-Muslims, and is etymologically derived from the word mujahada, signifying warfare to establish the religion.”
This has been a consistent feature of the writings of the finest minds in Islam for a thousand years, in other words.  They are the ones behind Islamic reformer Sultan Shaheen’s remarks that “For hundreds of years now, major Muslim theologians have been engaged in creating a coherent theology of intolerance and violence in order to expand the Islamic reach.”  He clarified, “Luminaries of Islam have established a theology which primarily says that Islam must conquer the world.”
That’s all ISIS is saying.  When are we going to be honest about the depth of the problem?   Pres Obamas remarks on the 14 dead in California that America should avoid stereotype and discrimination is disappointing.  If you read the Islam literature, as is above, you will understand what their mission is :  to conquer the world and yet it is all about rhetoric?   Is Obama a Muslim?


After learning that the radicalization spread among the Mollenbeek Muslim residents from CIB, run by a Muslim spiritual leader, and after learning that ISIS declared war vs Vatican, I was about to propose any or all of the following options:

      1.  Counter jihad, or somebody from the Church start a theology of counter jihad, a polemic to neutralize and even fight Islam. But somebody must start an active polemic and counter measure to stop this growing threat.  The Church has done active role vs oppression as it did in South America where Theology of Liberation originated vs. oppressors and dictators.  Now that ISIS has declared war vs the Church, will it simply wait for things to happen and not even have a working defense (militarily)

                     Can we have a new Holy Crusade ?

The Guardian - Karadizc sentenced 40 years for genocide

Seventy year old former Bosnia Serbian Leader Radovan Karadizc was sentenced to a 40 year jail term after being found guilty of 10 of 11 charges filed against him  The sentence came out 18 months after a 5 year trial.  He claimed that his actions were aimed at protecting the Serbs.  One of the noted events in his regime as the commander in chief of Serbia was the 1995 massacre of 8,000 Bosnians.men and boys in the Srebrenica enclave

The former Serbian President  Ivan Milosevic died in 2006 in Hague before the ICTY could render sentence unto the former leader.  Karadicz, and  3 others are undergoing trial:   his military chief  Ratko Mladic and ultranationalist leader Vojislav Seselj.

Kardadicz escaped arrest by disguising himself as new age healer Dr. Dragan Drabic wearing shaggy hair and thick beaard.

On Srebrenica, Kwon said: “On the basis of the totality of the evidence, the [ICTY] finds that the accused shared the expanded common purpose of killing the Bosnian Muslim males of Srebrenica and that he significantly contributed to it.”

More than 20 years after the guns fell silent in Bosnia, Karadžić is still considered a hero in Serb-controlled parts of the country, and the verdict is unlikely to help reconcile the enduring deep divisions in Bosnia and the region.

Many are pointing out that the Brussels attack happened (and could have been checked and prevented) had there been no lapses in intelligence and police work.   Molebeek for instance had several police districts and could have looked the other way at the activities (of Muslims) who compromise the bulk of the 100,000 population there. The fact was many of the terrorism committed in the past were traceable to Molenbeek, and still no red flag was raised.  Intelligence work, data bases on suspected terrorist could have been nil or sloppy.  Turkey emailed Brussels on one of the bombers who was a convicted criminal in Brusel who was briefly detained in Turkey for suspected terrorist activity.  His brother Khalid, suspect in Paris bombing continued to elude police.   Even relatives of the bombers notified the police of the radicalization of their relatives.  The police could have ignored/failed to act on the info.

An American intelligence officer was interviewed and this were the things he told about this Brussels incident:

1.  There are three stages in the aftermath of this attacks:   the chaos, identification of the suspect, and raids being conducted to gather more intelligence.

2.  The purpose of the raid is to gather more intelligence.  For instance, many are wondering why they can not identify the 3rd suspect.  The straightforward method is to show the picture of the suspect, and ask whom they arrested who he is.  That he is known to the Brussels police surprised the US intelligence officer.  The data base then should be analyzed for connection/links

3.  You cant play defense,with thousands of foreign nationals joining the ISIS at Syria.  A serious offense must be played.  Thus tracking the fighters and monitoring nationals returning from Syria, placing them on watchlist.

I would even suggest that Mollenbeek be zoned (as what the Japanesed did) or that it be razed.

4.  The police security and intelligence works would not be sufficient. While the tails are being cut, the head should be destroyed as well, like the killing of the #2 man of ISIS, the bag man.  Or cutting off their logistics like bombing the money stash of ISIS.

It is Good Friday in the Philippines.  For  Catholic On Line Org WWIII has begun and its between Islam and the rest of the world. The author says that politically people distinguish between extremists (the terrorists) and other Muslims who are pacificists.  But the author says the terrorists are merely following the order from Quran (to proslytize by the sword)

This thinking needs to be reframed. The militants are responding to the kafir (non-Muslims) as directed by the Quran. The book is very clear. You have a few basic options. You may convert, flee with nothing, pay a punishing tax, or die. 

What are you going to do to save your neighbor? Help save Christians from genocide.

The Quran also instructs that the entire world is to be converted. Islam is not just for a few Middle Eastern countries. No, the banner of Islam is intended for all nations, all the world. And if enticements of paradise don't work, then that banner should be raised with the help of the sword.

Also, in a more fundamental sense, the Qur’an stresses that all the prophets and messengers, speaking different languages and raised in various times and places, taught essentially the same perennial religion (core religion called deen), although their precise promulgation of the laws of religion, responding to extremely divergent historical circumstances and milieu, assumed different forms. However, these fundamental commandments, in essence and spirit, belong to the perennial religion that allows for no abrogation or alteration. Although one hardly finds these commandments enumerated in a single place in the Qur’an as they are listed in the Torah, nevertheless, all of them with the exception of the rule to observe the Sabbath— which, according to the Qur’an, was specific to the Jews, and, therefore, has only a rather limited significance—are enumerated in various places with varying emphases in the Qur’an; hence one can safely conclude that these commandments are of universal relevance meant for all times and places. Here is a listing of these commandments as enumerated in the Bible with their parallels in the Qur’an:

1. In Bible, “You shall have no other gods before Me” (Exodus 20: 2-3); in the Qur’an: (Your Lord has commanded that you worship none but Him) (Al-Isra’ 17: 23).

2. In the Bible: “You shall not make unto you any graven image … You shall not bow down to them or worship” (Exodus 20: 4–5); in the Qur’an, (Therefore keep away from the defiling idols.) (Al-Hajj 22: 30).

3. In the Bible: “You shall not take the name of the Lord your God in vain” (Exodus 20: 7); In the Qur’an, (Make not Allah, by your oaths, a hindrance to your being righteous) (Al-Baqarah 2: 224).

4. In the Bible: “Honor your father and mother” (Exodus 20: 12); in the Qur’an: ((Your Lord has decreed) that you show kindness to your parents) (Al-Isra’ 17: 23).

5. In the Bible: “You shall not kill” (Exodus 20:13); in the Qur’an: (And kill not one another) (An-Nisa’ 4:29).

A Belgian Parliament member, a lady a Muslim, was interviewed at CNN and she condemned the terrorist attack wondering how on the earth people can kill in the name of a religion, and how she can explain to others as a Muslim why this thing happened.. Those who committed the attacks were criminals and were in and out of jail and how come they were let go?

Its location in an international train station that can take anyone to London, Amsterdam, or Paris, makes an ideal center to launch operations and attack

It could be that there is lack of integration of Muslim immigrants, or that there is unemployment problem.   In Molenbeek, there is 40% unemployment rate.  however the growth of radicalization, which faced authorities has been there for the last 20 years.

Molenbeek started to become center of recruitment and radicalization of Muslim starting in 1997 by Ayachi Bassam, a French national formerly from Syria who established CIB  (Centre Islamic Belge) a family owned mosque.  It became the center for Al Qaida in Europe.  It is located just 3 miles from  Espace Leopold, the HQ of EU Parliament.

"Almost every time there’s a link with Molenbeek,” the Belgian prime minister, Charles Michel, said in the aftermath of the Paris attacks Nov. 13 that killed 130 people. “We’ve tried prevention. Now we’ll have to get repressive. It’s been a form of laissez faire and laxity. Now we’re paying the bill.”
What used to be the industrial part of metropolitan Brussels became the place where Muslim immigrants from Morocco to Belgium settled in 1964 when Belgium needed to expand its workforce. Today, the town of 94,000 is 40 percent Muslims. It has an unemployment rate of nearly 50 percent among young adults. It is home to at least 22 mosques and just five churches. The street names are the only clue to outside observers that they are in the heart of Europe. Traditional Belgian supermarkets first stopped selling alcohol and later turned into Islamic book stores.

This is shocking and this claim strikes at the very heart of Jewish, Islam, and Christian religion. Do you agree with the claim of the articles?

It is Holy Thursday.  I got the biggest shock of my life when there was a discussion about Moses. And the scholars declared that a man called Moses the escape from Egypt, never existed based on records of ancient Egypt (who had detailed accounts of their history)   There was no record of Jews being on Egypt, and if indeed there were 600,000 free men Jews escaping from Pharaoh, there could have been, if family members of family included, millions fleeing the army of the Pharaoh, and would have left archaeological evidences

MOSES NEVER EXISTED, EXODUS NEVER HAPPENED, Scholars agree.

The main book of Judaism, called the Torah (the first 5 books of the Old Testament, "OT") is filled with stories of a man called Moses, the story of Exodus and the persecution of Jews by an Egyptian king who allegedly enslaved them. 

The Torah is obvious mythology. The fact that it is fiction is obvious from Book 1, Page 1. The Earth is not 6000 years old. Cultures (unknown to the scribes) flourished much before. Written records and archeological evidence using carbon dating show man's presence tens of thousands of years ago, probably over a 100,000 years ago. A million people cannot live in a vast desert (without water or food) in a hostile nation for 40 years--and leave no trace. 

The Documentary Hypothesis showed that the Old Testament was weaved together out of four source documents by 4 authors and produced much later than claimed.

That is the Islam criticism on the Bible; full of thousands of errors. But it does not diminish according to the commentator, the truth on the Ten Commandments   Very few people honor their parents.  Many people steal.  Many people kill (the terrorists) the wars.  And many people covet

What do you think about this scholars finding?

This could turn the logical support of Christian Jew and Muslim religion, because it cracks wide open the foundation of the first five books of the scriptures and or weakens our belief.  We merely have to rely on our faith and the biblical history, as other sciences, the archaeological evidences would seem not to support the history

The Holy Week was greeted last March 22, 2016 by another terror attack in Brussel resulting in 34 dead and more than 270  wounded.  ISIS claimed responsibility for the bombing.  Brothers Khalid and Brahim el-Bakraoui – both Belgian nationals – have been identified to have carried out the attack at the Belgian International Airport and Maelbek Metro Station

The bomb used could have been TATP, triacetone triperoxide, "The Mother of Satan" manufactured from acetone, and hydrogen peroxide both of which can be obtained anywhere.    About 30 gallons of acetone were found at the suspected lair of the bombers and 30 lbs of TATP which could be used for future bomb attacks. It calls for delicate manufacture as TATP could be unstable and affected by heat (not suitable in PH)  It is 80% as powerful as TNT.  All it takes is a firm tap to explode it.

What is the significance of this discovery?  The terrorist are on a new level of innovation in creating havoc because TATP does not emit nitrogen and could not be detected using the current methods.  Therefore, TATP is easily transportable in airports and mobile.  Even bombs are mobile.

Should selling of acetone, a common chemical used for cleaning nail polish, and hydrogen peroxide (it has to be made concentrated by boiling out the water) be banned and or controlled?

Will the police be able to catch up with the evolving terrorist tech?
