Tomorrow we commemorate the birth date of the great Plebian, perhaps the real Philippine National Hero who fought for our country using his own name, and not because the friars took away their land.

But that reminds of the stark reality that there are constant reminders of suspension of writ of habeas corpus (after the declaration of state of lawlessness)  Martial Bonifacio (the name used in passport of Ninoy) may just be around the corner.  Digong has heads and hands full with the following:

1.  Uncontrolled kidnapping by ASG in Mindanao despite 10,000 strong military ops;

2.  Maute rebellion in Mindanao, even ambush of his advanced convoy;

3.  Traffic problem (he still does not have emergency powers;   Political foes are giving him a hard time

4.  The drug problems:

      Talamak na involvement ng govt officials elective and appointive and even in his very own police force which he trusts:  generals cols.  BUCOR officials

5.  Graft and corruption

      CSC laws, due process, Constitutional rights protecting corrupt officials.  The slow wheels of justice and govt grinds very slowly to defy efforts to clean the govt of corruption.  No the ERC officials will not resign because they have a tenure to be observed just like judges.

    Corrupt govt officials entrenched in the legislative and judicial branches.    And they have lawyers and laws behind them.

    Corrupt barangay officials and LGU officials -  their kotong ways have not abated.

    Campaign vs corruption in various depts are met with strong resistance as in DOJ, and even assassination as in Bureau of Customs

As fmr Senator and fmr expert on martial law, Pres Duterte needs the declaration of martial law to combat crimes and solve all other challenges of the country.  I will do the same if I were the President.  An achiever can do no less.  A man of honor and respect for his word will demand nothing less to achieve his goals

In democracy, majority rules, the minority should abide by the decision of the majority (of course while continuing to oppose and fiscalize)  But the polls recently conducted shows 71.6 % or 2 out of 3 of MM residents favor the burial of the late President at LNMB.  

So only a minority objects.  Let the dead bury its dead.

Ombudsman To Pursue Investigation On Complaints Against Duterte

Ombudsman Conchita Morales Carpio, in a speech before the homecoming of UP College of law said that she is appalled by the indifference of people to historical revisionism and leaders who let this happen.

This may be the personal opinion of the good ombudsman but she and her office are insuperable.  It now has exposed her political views and her partiality which may cloud her judgment and her position entrusted to an office that should be be viewed and observing fairness,  impartiality and objectivity

Officers of the judiciary are selected on their wisdom and on  the above.

What is the role of the ombudsman?  From Ombudsman\ web.  Has the ombudsman crossed the limits of her job responsibility and authority

Can her office investigate  the OP prior to impeachment?    Ombudsman to continueinvestigating Sen Trillanes compalint vs Pree Duterte for plunder Can her office be investigated by other bodies unless she is impeached.

In the Senate hearing yesterday, a member of the committee who was mentioned in the testimony of Kerwin Espinosa flatly denied the allegation by the witness and even declared that the affidavit of the same of scripted.  I do not think that the lady is a she but an alpha male and knows the 12 commandments (11th- thou shall not get caught.   12th -  when caught DENY)

Even as the hearing is being held the defense lawyers are sifting probably through the video to find weaknesses in the affidavit and now strategizing how their clients can be defended.  The denial perhaps is a way of throwing off balance the prosecution and the heighten mass media appeal.

As the SOJ even acknowledges, putting the accused behind bars would be a daunting and difficult task because she has the money and resources to fight the prosecution in courts, and even an expert in law herself

The Senate hearing on the testimony of Kevin Espinosa an alleged drug lord in Eastern Visayas just went into recess a few minutes ago, after a long arduous recitation of his affidavit and inquiry into processes of various police units like the IAS (which looked very slow and can not prosecute its own kind)

One gets a glimpse of filial devotion, the greed and inhumanity of police officers down from PO up to Generals and double cross, and the defects in police work, and why the drug ring is spreading.

Some important details:

1.  The POs get P5t a week, captains up to P15 a week, Generals about P100t a month coupled with advances;  a Colonel got P3 million for the campaign of his wife, whose only duty was an augment force of 100 and whose important task is to set up check points.

2.  The good senator who is a denial queen got some P8 million from him in various places in Manila (MoA) and in Baguio through his driver love who was also captured.  They even had photo ops in Baguio (a damning proof)  She vehemently denies this (of course her lover got it and did not remit this to her the usual defense)

3.  Despite all these his father got killed inside a jail on the strength of a search warrant issued by the same judge and which happened in the same jail. at Baybay Leyte.

Before he had strong admiration for some of the policeman but one can puke at the rabidity and greed of police officers and some of them were even in the hearing.

The alleged affidavit of late Mayor Espinosa appeared to have been signed under duress because he was not given access to legal counsel.  For Albuera Chief Jovy Avenido, the prosecutor presence was enough counsel and kept insisting on this to the end much to t he chagrin of committee chair Gordon. For a police officer who is supposed to serve and protect the rights of civilians, not to understand the rights of the accused makes many cases fall apart or be lost in courts.

The said Avenido turned out to be have shot and killed a gasoline boy in mistaken identity.  He was able to get a compromise but Gordon stated that one can not compromise the criminal portion of the offense.

IAS seem not understand the meaning of summary hearing (an abbreviated hearing based on affidavit which is settled in 5 days or less for administrative purposes only) and could not give deadlines.

Even as we conduct the drug war, things will get worse despite the leadership of Gen Bato, who seemed to be flabergasted with the lapses in procedure and even the integrity of men under him.  He calls Albuera Chief Avenido a disappointment. (He even brokered the meeting between Dayan and Kerwin.) He was disappointed and became emotional as to who can be trusted or not

Of all the hearings this is the clearest, very focused and arrived at something concrete and positive.

The long arm of the law finally caught up with fugitive Ronnie Dayan.  He was finally "captured" in San Juan La Union.   He was according to conflicting reports, (as claimed in Camp Crame) subject of a long search and evasion operation in the mountains of La Union.  However the video of ABS CBN showed otherwise that the relatives of Dayan were ahead of the police in getting to Dayan in a field in the said town.  (Was he captured/arrested or somebody - the relative of Dayan tipped off the press.  As we watch Espinosa, and the widespread involvement of policeman in drugs and inconsistency of police and police officers in their testimony and action, one casts doubt in the truth of some of police reports.   De Lima was right in her advocacy, except that now, she may have dirty hands)

What is heartening is that an important witness in the NBP drug trade and the allegedly involvement of a top level official is finally found.   He may provide the link between the lady official and the said driver.   But at the end of the day, without the documentary evidence, it can not be established beyond the reasonable doubt that  the lady received the money from the lover. (although he admitted that they were on for 7 years.

Will she be convicted on the basis of Dayans capture?  I doubt.  Naw

This post was totally shocked and dumbfounded when fnr Pres Ramos denounced the Marcos family after alleged secret burial of fmr Pres Marcos at LNMB.  He lambasted them for the alleged stealthy burial and that fmr FL Imelda Marcos should apologize to the Filipino people

Perhaps it is a way of atonement and distancing himself from the family for he is  a 2nd cousin of the President (I do not know how)  He was second in command of the chain of command of the military which implemented the orders of the late dictator. He and JEP

On the same breadth as arguments vs Marcos burial, they too should be denied LNMB burial, even as they served at DND or the military as mandated by the Pantheon for Heroes law

They are trying very hard to erase themselves from the atrocities of the dictatorship but they commanded the organization that  committed the PCO, the arrests, the detention, the interrogation and other alleged atrocities and human rights violation.  We can not change history, no matter how much they try to make pronouncements.

Dapat mahiya si Ramos sa taong bayan at sa mga Marcos.  He was under their wings in his heyday. Sana marami pang taga sunod at naniniwala kay tabako

Do the guys, the leaders in Manila the seat of power understand what the President from Mindanao is trying to do.  Many of the things do not seem to rhyme.   He attacks US, he sides with China, then reverses himself and pushes through with the deal, sides with the Reds and then allow Marcos burial?

Well, the Pres who very much politically adroit as all politicians should, believe that politics should be addition and as much as possible would like to bring all sectors of the govt, the left the right, the center to be together.  He sides with the police wooes them, he visits the military in their camps, breaks protocol and allows Misuari to speak at the Pres. podium.   He is practicing inclusiveness to the hilt.

At the international scene:

1.  He is trying defuse tension between China and PHL (he knows that in case of a shooting war, we cant defend ourselves let alone US defend us -  US is heavily indebted to China and very much dependent on China for its supplies

2.  He tries to attend international conferences and try to get economic alliances to bring in more investments and export opportunities which were not available or visible  when we continued to be under the wings of US.  How much trade did we gain from China visit and conversation with Russian Pres. V Putin.  

There is some coherence in his actions and not crazy as some think

It is not true that the Pres is only drug focused from the above.

ERC officials defy Duterte = will not resign

It appears that Pres. Duterte even faces the greater and more daunting challenge, far greater than illegal drugs that is fighting corruption.  All ready we signs of such challenges.  For the illegal drugs, at least we know who the enemies are and the boundaries (although the supporters of the drug trade could have infiltrated the govt within as is the case for narco politics.  However for corruption is from within and the laws, the due process, the security of tenure protect many of the culprits.

1.  The deputy customs commissioner investigating corruption in customs, Lachica was shot dead.

2.  There are alleged grumbling protests at DOJ wanting Sec Aguirre to be replaced because he is waging campaign vs corruption

3.  An RDO officer was gunned down, and he had with him P300,000 in cash (what a cash settlement for taxes in arrears?)

All ready we have passed the 100 days and we do not see much change in terms of eradication of corruption.  The syndicates are still there, the old connection are still there, many govt offices are still ineffficient.   At the barangay level, high level corruption continues.  Elected and appointive govt officials lord it over and still continue their old corrupt ways.  Not much has improved in the fight vs corruption.

As in the case, of  ERC when the Pres asked for resignation of the commissioners many did not comply and so the Pres. threatened to remove their budget.This stemmed from the suicide note of the chair of bids system Villa, who alleged in his suicide note that he was pressured to approve contracts without bidding?  Who has the greater will - the dewfenses of the corrupt ways and defenses or the fight for the right?

A number of protests has erupted and many so cal led leaders have protested the haste and the secrecy that surrounded the burial of FM at LNMB at  Taguig. They said that the SC ruling is not yet final and executory  This was according to lawyer Romy Macalintal


The SC spokesman said there is no appeal vs burial.   The November 8 ruling that upheld the order of Pres Duterte also  lifted the ante order previously granted in September

Ombudsman Morales has ordered the Senate President Koko Pimentel to dismiss elected Senator Joel Villanueva over alleged scandal of P10 million in PDAF.  Sen Joel has appealed to the Ombudsman.

Meanwhile, Sen Franklin Drilon that the power of the Ombdudsman to dismiss govt officials does not apply to Senators and Congressmen (Hence Sens. Jinggoy, JPE, and Revilla were not dismissed despite their incarceration.

There is a lot of ruckus going on over the freebie given to Gen Bato and family (free plane and accommodation) to watch his recent fight vs Jessie Vargas.   Gen Bato clearly violated PD 46 and the provisions of Code of Conduct and Ethics for govt employees.   Clearly too that this is political since De Lima, a fellow lady who has tons of accusation is not being investigated

Clearly too this is selective justice at work since in the past, the good Senator accommodated a lot of free loader solons for many of his fight.  Why only now is there such an investigation

Clearly this is to stop Gen Bato dead on his tracks and to discredit him.  All that they have to do is convict him, and as promised by Pres Duterte to pardon him.  Neat eh

1.  The Supreme Court allows the burial of late Pres Marcos at Libingan ng mga Bayani

2.  The election results of November 8, 2016 resulted in Donald Trump being the next President of the Philippines.  A number of anti Trump protest erupted in major US cities. (for anti illegals and immigrants pronouncemnet  All ready, EU is reacting (and the rest of the world) for the pro US rhetoric of Trump vs the rest of the world.

/Defeated candidate Clinton is heard to urge her followers to continue fighting.  If unstopped this could lead to widespread US disorder (We thought, Trump would be the one not to accept defeat
